These Terms & Conditions (“Terms”) govern your booking and participation in tours, picnics, and other experiences offered by Nichols & Company(“we,” “us,” or “our”), operating the brands TourCWE, Forest Park Picnics, and the storefront at racon.tours.
By booking with us, you agree to these Terms.
1. Bookings & Reservations
Booking platform. Bookings are processed through our reservation platform, Bókun. A confirmation email is sent immediately after a successful booking. If you do not receive a confirmation within an hour, contact us — your booking may not have completed.
Accuracy of information. You are responsible for providing accurate names, contact information, and the number of participants. We rely on this information to deliver your experience.
Age requirements. Some experiences have minimum age requirements, listed on each booking page. Children below the minimum age cannot participate, even if accompanied by an adult.
2. Payment
Full payment is required at the time of booking. Payments are processed securely by our booking platform; we do not store credit card information.
Prices are listed in U.S. dollars and include applicable taxes unless stated otherwise. International customers will be charged in their local currency at prevailing exchange rates determined by their card issuer.
3. Cancellations & Refunds
Customer cancellations:
- Cancel 24 hours or more before your scheduled experience: full refund
- Cancel less than 24 hours before: no refund
- No-shows: no refund
Cancellations by us. We reserve the right to cancel any experience due to insufficient bookings, severe weather, safety concerns, or other circumstances beyond our control. If we cancel, you will receive a full refund or the option to reschedule. We are not responsible for additional costs you may have incurred (travel, lodging, etc.).
Weather policy. Walking tours and picnics generally proceed in light rain. We will only cancel for severe weather (thunderstorms, extreme temperatures, dangerous conditions). If we cancel for weather, you receive a full refund or rescheduling option.
Rescheduling. Subject to availability, you may reschedule a booking up to 24 hours before your experience at no charge. Rescheduling within 24 hours is not guaranteed.
4. Tour Participation
Walking tours. Our walking tours involve approximately 2 miles of walking over 3 hours, on city sidewalks, with stops at restaurants and points of interest. Participants should be able to walk this distance and stand for periods of time. Wear comfortable shoes and weather-appropriate clothing.
Picnics. Picnic experiences include food prepared by partner restaurants. Pickup or delivery details are provided in your confirmation. Picnics are sold per basket; sharing is at your discretion.
Dietary restrictions. Notify us at least 24 hours before your experience if you have allergies or dietary restrictions. We will do our best to accommodate them but cannot guarantee an allergen-free environment, especially for tours that include multiple restaurants.
What’s included. Each booking page lists what is included in the price. Gratuities for tour guides are appreciated but not required.
5. Assumption of Risk & Liability Waiver
Walking tours and outdoor picnics involve inherent risks, including but not limited to: tripping or falling on uneven surfaces, exposure to weather, traffic near streets and crosswalks, food allergens, and incidents beyond our control.
By booking, you acknowledge and accept these risks on behalf of yourself and any minors in your party. You agree that participation is voluntary and at your own risk.
To the fullest extent permitted by law, you release Nichols & Company, its employees, guides, and partners from liability for any injury, loss, or damage arising from your participation, except where caused by our gross negligence or willful misconduct.
6. Photography & Marketing
We may take photos or video during tours and picnics for marketing purposes. By participating, you grant us permission to use your image in marketing materials without compensation. If you do not wish to be photographed, notify your guide at the start of the experience.
7. Code of Conduct
We reserve the right to remove any participant whose behavior is disruptive, disrespectful, intoxicated, or unsafe, without refund. This includes but is not limited to: harassment of guides or other guests, failure to follow safety instructions, and actions that endanger others.
8. Third-Party Bookings
If you booked through a third party (Viator, GetYourGuide, Tripadvisor, etc.), the booking and cancellation policies of that platform may apply in addition to or in place of these Terms. Please review the policies of the platform where you booked.
9. Intellectual Property
All content on our websites — text, images, logos, tour content, marketing materials — is the property of Nichols & Company or our partners and is protected by copyright. You may not reproduce, distribute, or create derivative works without our written permission.
10. Disclaimer of Warranties
Our services are provided “as is.” We make no warranties about uninterrupted availability, accuracy of historical information shared on tours, or specific outcomes of your experience.
11. Limitation of Liability
To the fullest extent permitted by law, Nichols & Company’s total liability for any claim arising from these Terms or your participation is limited to the amount you paid for the affected booking.
12. Indemnification
You agree to indemnify and hold harmless Nichols & Company, its employees, and partners from any claims, damages, or expenses arising from your violation of these Terms or your participation in our experiences.
13. Governing Law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute arising from these Terms or your participation will be resolved in the state or federal courts located in St. Louis, Missouri, and you consent to the personal jurisdiction of those courts.
14. Changes to Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent changes. Bookings are governed by the Terms in effect at the time of booking.
